Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the Alpha Asbestos Australia website (alphaasbestos.com.au) and the engagement of our asbestos removal, testing, and disposal services. By using our website or engaging our services, you agree to be bound by these Terms.

1.Definitions

  • “Company”, “We”, “Us”, “Our” refers to Alpha Asbestos Australia.
  • “Client”, “You”, “Your” refers to the person or business engaging our services or using our website.
  • “Services” refers to any asbestos testing, removal, disposal, or related work carried out by Alpha Asbestos Australia.
  • “Quotation” refers to the written or verbal price estimate provided by us for the proposed scope of works.
  • “Site” or “Premises” refers to the property at which Services are to be performed.

 

2. Licence and Compliance

Alpha Asbestos Australia holds a current Class B asbestos removal licence issued by WorkSafe Victoria and operates in accordance with:

  • The Occupational Health and Safety Regulations 2017 (Vic)
  • The Environment Protection Act 2017 (Vic)
  • The How to Safely Remove Asbestos Code of Practice and any applicable Australian Standards
  • All relevant EPA Victoria requirements for transport and disposal of asbestos waste

Our licence covers the removal of non-friable (bonded) asbestos-containing materials.

 

3. Quotations

  • All quotations are based on information provided by the Client and a site assessment where applicable.
  • Quotations are valid for 30 days from the date of issue unless otherwise stated.
  • A quotation does not constitute a binding contract until accepted in writing (including by email or electronic confirmation).
  • Quoted prices are inclusive of GST unless stated otherwise.
  • We reserve the right to amend a quotation if the actual scope of works is found to differ materially from what was described or assessed prior to quoting (see Clause 8 – Latent or Unforeseen Asbestos).

 

4. Booking and Commencement

  • Works will be scheduled following acceptance of the quotation.
  • Start dates are subject to licence requirements, weather conditions, and the availability of our team.
  • The Client is responsible for ensuring safe and unobstructed access to the Premises on the agreed date.
  • If access is not available on the scheduled date due to circumstances within the Client’s control, Alpha Asbestos Australia reserves the right to charge a call-out fee.

 

5. Payment Terms

  • Payment terms will be specified in your quotation or invoice.
  • For residential jobs, full payment is typically required upon completion of work.
  • For commercial or industrial projects, payment terms will be agreed in writing prior to commencement.
  • Invoices not paid by the due date may incur interest and/or recovery costs.
  • We accept payment by bank transfer or as otherwise agreed.

 

6. Cancellation and Rescheduling

  • Cancellations must be made with a minimum of 48 hours’ notice prior to the scheduled start date.
  • Cancellations made with less than 48 hours’ notice may incur a cancellation fee.
  • We reserve the right to reschedule Services due to inclement weather, unsafe site conditions, or circumstances outside our control.

 

7. Scope of Works

  • All Services will be performed strictly in accordance with the agreed scope of works as outlined in the accepted quotation.
  • Work will be carried out in compliance with applicable WorkSafe Victoria and EPA Victoria requirements.
  • Any variations to the agreed scope must be approved in writing by both parties prior to the additional work being carried out. Variations may affect the final price.

 

8. Latent or Unforeseen Asbestos

  • Our Services cover only the asbestos-containing materials specifically identified and included in the agreed scope of works.
  • We are not liable for asbestos that could not reasonably be identified at the time of the site assessment, including asbestos concealed within structures, underground, or discovered following the commencement of works.
  • If additional asbestos-containing materials are identified during the course of works, we will notify the Client and provide a revised quotation before proceeding.

 

9. Clearance Certificates

  • Where a clearance inspection is carried out upon completion of the Services, the clearance certificate issued confirms that the areas specified are visually clear of asbestos debris and are suitable for re-occupation.
  • The Client’s re-occupation of the cleared area constitutes acceptance of the clearance certificate.
  • We are not liable for errors or omissions made by any independent occupational hygienist or NATA-accredited laboratory engaged in connection with the Services.

 

10. Limitation of Liability

  • To the maximum extent permitted by law, Alpha Asbestos Australia’s liability for any loss or damage arising from the Services is limited to the value of the Services provided under the relevant quotation.
  • We are not liable for any indirect, consequential, or economic loss, including loss of income, loss of business opportunity, or damage caused by factors outside our control.
  • Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be lawfully excluded.

 

11. Client Responsibilities

The Client agrees to:

  • Provide accurate and complete information about the property and any known or suspected asbestos-containing materials
  • Ensure all relevant persons vacate the designated work area prior to and during removal works
  • Not re-enter the work area until a clearance has been issued or the area has been declared safe by our team
  • Comply with any site preparation requirements we advise prior to commencement

13. GST

All prices quoted are inclusive of GST (Goods and Services Tax) unless expressly stated otherwise. GST is charged in accordance with the A New Tax System (Goods and Services Tax) Act 1999 (Cth).

 

14. Governing Law

These Terms are governed by the laws of the State of Victoria, Australia. Any disputes arising under these Terms are subject to the exclusive jurisdiction of the courts of Victoria.

 

15. Changes to These Terms

We reserve the right to update these Terms at any time. The current version will always be published on our website. Continued use of our website or engagement of our services following any update constitutes acceptance of the revised Terms.
